  • Contesting a Will on the basis that the deceased did not have the mental capacity or had been unduly influenced at the time when the will was made.
  • Making a family provision claim against a deceased estate. This claim arises when the deceased did not make proper and adequate provision for the claimant. The persons entitled to make such a claim include the married or de facto spouse, the parents, the children and grandchildren maintained by the deceased.
  • Defending a claim against a deceased estate.
  • Disputes with executors, administrators and beneficiaries.
  • Dealing with a deceased estate based overseas with assets in Australia.
  • Proving informal wills to the court. This occurs when the deceased did not make a formal written will but left some form of writing or recording setting out the deceased’s intention with respect to the distribution of assets upon death.
  • Application for a Grant of Probate when the deceased left a will.
  • Application for Letters of Administration when the deceased did not leave a will.
  • Administration of a deceased estate including collection of assets, clearing tax liabilities and distribution to the beneficiaries.

Our experience shows that many executors, administrators, beneficiaries and potential claimants have limited experience in dealing with legal issues and are often reluctant to seek legal advice on account of the legal costs involved. Hence, the purpose of the Legal Help Project is to provide affordable, accessible and accurate legal advice to the community.
